Whilst we can’t foresee every situation that might happen in our relationship, we owe it to ourselves to protect our financial interests every step of the way or you could find yourself many years from now much worse off and in a poorer financial position. This is especially important if you already have children from a previous marriage or relationship, or your own property, or you have business interests.

Cohabitation Agreements or Living Together Agreements

Cohabitation Agreements help to set out your understanding of the terms of your relationship and the treatment of assets and property ownership should you part. It normally assesses both jointly owned assets and individual assets. In other words – what you had before you got together and what’s the difference now. It can extend to financial, medical and funerary arrangements and is binding until the contract is dissolved or one of you dies.

Pre-Nuptial Agreements

A Prenuptial Agreement, commonly referred to as a ‘PreNup,’ is a legal document prepared between a couple before
marriage that outlines how their assets will be divided if they divorce. Essentially, a prenup clarifies “who gets
what,” but there are many factors to consider before agreeing to one. The main purpose of a prenup is to provide clarity
on asset division should the relationship end. They are particularly important if there is a significant disparity in
wealth between you and your partner; unequal pension or asset values, inheritance to protect, a successful business that
needs protection, or business failures that could drain financial resources, leading to debt, or one party has
considerable debt compared to the other.

It is also prudent for each party to make a Will, so that if either party should die during the relationship or
marriage, then there is clarity to understand your wishes regarding beneficiaries and distribution of assets. Making a
Will is extremely important if either of you have children from a previous relationship.
