One of the most notable exclusions from a Deputy or Attorney’s authority is making gifts on behalf of the Protected Party or Donor.

It makes sense when you think about it. Gifting should only be done when the person is in a comfortable financial position and the gifting would not impact their quality of life.

Gifts are usually made to close family members, who are often the Deputy/Attorney or their loved ones. Without proper checks, dishonest people could take advantage of a vulnerable person.

This is why an application to the Court of Protection is normally required, except in limited circumstances as set out in the Deputy Order or the Office of the Public Guardian (OPG) guidance.
