Tenants must obtain consent for significant alterations

Tenants must obtain consent for significant alterations from their Landlord. Once the alterations are made, tenants must also adhere to the ‘dilapidations’ clause in their lease contract which outlines how a tenant should remedy the premises back to its original state before the next tenant comes in.

A Licence for Alterations is a written document between a Landlord and their tenant/leaseholder. It gives the leaseholder formal permission to carry out works or make changes to the property that is leased. Without the agreement to alter, the leaseholder has no rights to change the property.

As most leases deny leaseholders from making any significant changes, like partition walls to be removed or altered, windows removed or doors added, a Licence for Alteration is a useful tool for leaseholders to make modifications to their existing premises and to therefore stay in the premises because it meets their needs more fully than it would have done had they not made the modifications.

A Licence for Alterations will normally involve the leaseholder providing details, visual drawings and technical information about the changes suggested. These documents and details enable the Landlord to make a decision as to whether they are happy for the modifications to be made, or not, or to comment on the proposed changes so that they can provide feedback to alter or change them further, before being accepted.

A Licence for Alteration is therefore a useful tool that can extend a leaseholder’s tenancy duration.
