Lord Young of Graffham’s much awaited Health & Safety review has just been published, bringing the personal injury arena into the spotlight. Established Leicester accident claim solicitors and APIL accredited member Lawson-West believe the recommendations of the review do little to set the record straight with regard to ‘the compensation culture’ – a phrase which suggests people are claiming compensation more and more. In actual fact statistics from the Government’s Compensation Recovery Unit show the opposite is true with a reported decline in the majority of types of compensation claim between 2001 and 2010.

What may be a factor is an increase in the number of firms advertising their services in this area, often prominently through media such as TV so the public is more aware, in general, of the personal injury sector.  However, reforms to the sector could be damaging to vulnerable people who have genuinely suffered as a result of a third party’s negligence. What the review falls short of, is an explanation of the difference between a no fault accident and negligence – where someone has suffered as a result of someone else’s actions.


Furthermore, Lord Young’s reforms to Health & Safety Laws, while in some areas may be welcome, pose a serious risk in the area of employer’s liability cases. Reducing health and safety regulations may result in an increased risk of accidents, while changes to the claims process could make it virtually impossible for an injured person to obtain the redress they deserve.
