A cyclist has been awarded full compensation for the injuries he sustained after being in collision with a motorbike despite not wearing a cycling helmet.

 

The High Court found that the motorcyclist was liable for the accident as the biker had tried to overtake the bicyclist without leaving sufficient room and whilst travelling over the speed limit.  The biker’s insurer’s argued that the bicyclist’s injury compensation should be reduced by 25% because the bicyclist was not wearing a helmet. 

 

Although the court agreed that cyclists could place themselves at greater risk if they did not wear a helmet, the court disagreed that the compensation should be reduced.  The court found that the biker’s insurers had not provided evidence that the bicyclist would have been less severely injured had he been wearing a helmet.
