The Ministry of Justice have reported an increase in enquiries about who can help employees or employers with Compromise Agreements. Advice about Compromise Agreements can only be given by a qualified lawyer, a qualified trade union official or a qualified advice centre worker, all of whom have to be covered by an appropriate certificate of indemnity insurance. This requirement is set out in the Employment Rights (Dispute Resolution) Act 1998. Compromise Agreements can be packed with legal jargon and refer to Acts and Regulations. It is vitally important that you understand the full implications of what you are being asked to sign as you will not necessarily be able to make an Employment Tribunal claim later. Compromise Agreements can also contain clauses or restrictive covenants governing whether you can contact former clients or colleagues and you need to be confident these will not interfere with your future plans.
