A recent Employment Appeal Tribunal decision has held that an employer is in breach of the Employment Equality (Religion or Belief) Regulations 2003 if an employee is harassed because another employee holds certain religious beliefs. In the case of Saini v All Saints Haque Centre, the tribunal reasoned that discrimination on grounds of religion or belief applies to both instances where an employee is discriminated against because of his or her own religion or belief and/or where an employee is discriminated against because of another employee’s religion or belief. The claimant had been harassed by other employees and the tribunal had to decide whether the claimant was harassed because the other employees wanted to get rid of another employee regardless of the reason or if the other employees were harassing the claimant to get rid of an employee solely because he was a Hindu. The All Saints Haque Centre was effectively under the managerial control of a group of employees who were of the Ravidass faith and this group of employees were harassing staff who were not of the same faith. The Employment Appeal Tribunal found that this group of employees had wanted to get rid of an employee solely because he was a Hindu and the claimant had been discriminated against on grounds of religion. The employers were in breach of the Employment Equality (Religion or Belief) Regulations 2003.
