New products have to be fit for purpose, ie shoes have to be fit for walking in, and if a faulty product causes injury, the injured person could have an accident claim. Recently a 20 year old woman won compensation for her injuries after the heel of shoe snapped.

She had kept the receipt so was able to prove where she’d bought her shoes after the heel snapped on the first time she’d worn them. The broken heel led to her falling and breaking her ankle. She was taken to hospital after falling. She had to undergo surgery and spent several weeks with her ankle in a cast. Her broken ankle prevented her from taking a job over her Christmas holidays and preventing her taking part in sports activities at university. She launched an injury compensation claim against the retailer who admitted liability.
