The local authority is responsible for repair and maintenance of pavements and highways. They should have a programme of inspection and repair in place. We would check the inspection records to see if the local authority was aware of the defect that caused your accident.
If you trip in the street because of badly maintained paving and sustain serious injury:-
Seek medical advice you need to have a record of your injuries.
Take photographs of the defect, preferably showing the measurement of the defect, eg with a tape measure or a 50 pence coin (these are generally 1 high).
Measure the defect on the pavement to confirm it is 1 or more in height as there is a general rule that defects must be 1 or more for the local authority to take responsibility for it.
Report your accident to the local authority. They may repair the area after your report so you need to ensure you have photos of the defect before the local authority repairs it.
If anyone helped you after your accident, take their name and phone number as they may be a witness who could support your claim.
